[CALL TO ORDER AND ANNOUNCE A QUORUM IS PRESENT]
[00:00:10]
ALL RIGHT. GOOD EVENING EVERYONE. TIME IS 7:03 P.M. ANNOUNCED THAT A QUORUM IS PRESENT AND WILL CALL TO ORDER THE CITY COUNCIL REGULAR MEETING.
OH, HEY, MY AUNTIE. REVEREND BELL MALATA. GOOD AFTERNOON, GOOD EVENING. GOOD EVENING MAYOR. GOOD EVENING. AMEN. LET US BOW OUR HEADS. LORD, YOUR WORD SAYS THAT WE SHOULD PRAY FOR THOSE IN AUTHORITY AND FOR THOSE IN LEADERSHIP. AND TONIGHT, I PRAY FOR OUR MAYOR. I PRAY THAT YOU WOULD GIVE HIM YOUR MIND. OH, GOD. AND I PRAY THAT YOU WOULD SURROUND HIM WITH WISE COUNSEL, AND THAT YOU WOULD BLESS ALL THAT HE ENDEAVORS TO DO AS HE WORKS FOR THE ENRICHMENT AND BETTERMENT OF THE CITY OF MAYNOR, IN JESUS NAME. I ALSO PRAY FOR EVERY CITY COUNCIL MEMBER THAT YOU HAVE DIVINELY APPOINTED FOR SUCH A TIME AS THIS. MY PRAYER IS THAT THEY WORK HARMONIOUSLY AND EFFECTIVELY AS THEY MOVE TOWARDS THE ENHANCEMENT OF THE CITY OF MAYNOR. I ALSO PRAY FOR THAT UNIQUE VISION INVOLVING FUTURE PLANS THAT EVERY APPOINTED LEADER OF THE CITY OF MAYNOR CARRY IN THEIR HEARTS. I PRAY THAT THESE PLANS WILL BECOME A SUCCESSFUL REALITY THAT WILL BRING OUR CITY TO THE FOREFRONT LIKE NEVER BEFORE, AND CAUSE THE CITY OF MAYNOR TO STAND OUT GREATLY IN ALL AREAS. MAY GOD BLESS THE CITY OF MAYNOR. IN JESUS NAME, AMEN. AMEN. THANK YOU. I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA, AND TO THE REPUBLIC FOR WHICH IT STANDS. ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. YOU ALL MAY BE SEATED. ALL RIGHT. FIRST UP, WE HAVE A
[PRESENTATIONS]

THANK YOU MA'AM. I, SIERRA PARKS, SOLEMNLY SWEAR. THAT I HAVE NOT, DIRECTLY OR INDIRECTLY PAID, OFFERED PROMISE TO PAY, CONTRIBUTED OR PROMISE TO CONTRIBUTE ANY MONEY TOWARDS ANY MONEY OR THING OF VALUE OR PROMISE OR PROMISED ANY PUBLIC OFFICIAL, ANY PUBLIC OFFICIAL OR EMPLOYMENT FOR THE GIVING OR WITHHOLDING OF A VOTE AND THE ELECTION OF A VOTE AT THE ELECTION AT WHICH I WAS ELECTED, OR AS A REWARD FOR MY APPOINTMENT TO SECURE MY APPOINTMENT OR CONFIRMATION, WHICH IS, WHICHEVER THE CASE MAY BE. AND I FURTHERMORE DO SOLEMNLY SWEAR THAT I WILL, THAT I WILL FAITHFULLY EXECUTE THE DUTIES OF THE OFFICE OF THE OFFICE OF ASSOCIATE JUDGE OF THE CITY OF STUDENTS OF THE CITY OF MAYNOR, THE STATE OF TEXAS, AND WILL TO THE BEST OF MY ABILITY AND WILL TO THE BEST OF MY ABILITIES, PRESERVE, PROTECT AND DEFEND THE CONSTITUTION AND DEFEND THE CONSTITUTION AND LAWS OF THE UNITED STATES AND OF THIS STATE, AND THE CHARTERS AND ORDINANCES AND THE CHARTER AND ORDINANCES OF THE CITY OF THIS CITY. SO IF WE CAN CLEAR THE BACKGROUND AND LET YOU ALL GET A FAMILY PHOTO WITH ALL YOUR GUESTS, IF THAT'S WHAT YOU WOULD LIKE TO DO. OKAY. I WANT TO COME UP. ON THAT SIDE OF. THE.[00:05:24]
TABLE. RIGHT. A THE LITTLE ONES UP FRONT.OKAY. OKAY. READY? FIVE. FOUR. THREE. TWO. ONE. GREAT. FIVE. FOUR. THREE. TWO. ONE. ALL THOSE BEAUTIFUL FACES. OH! OH. GREAT. PERFECT. ALRIGHT. YOU SHOULD, YOU SHOULD. FIVE. FOUR. THREE. TWO. ONE.
WAIT, WAIT. OKAY. FIVE. FOUR. THREE. TWO. ONE. THANK YOU.
CONGRATULATIONS. TO MAKE SURE. THIS IS AWESOME. HERE WE GO. I WAS WONDERING HOW THE CARS.
[PUBLIC COMMENTS]
ALL RIGHT. THANK YOU ALL FOR YOUR PATIENCE. WE'RE GOING TO MOVE RIGHT INTO PUBLIC COMMENTS.NON-AGENDA ITEMS ARE ON THE WHITE CARD. COMMENTS WILL BE TAKEN FROM AUDIENCE MEMBERS, NOT TO EXCEED NON-AGENDA RELATED TOPICS FOR LENGTH OF TIME, NOT TO EXCEED THREE MINUTES. AND I WILL KEEP YOUR TIME UP HERE. AND LET YOU KNOW WHEN THERE'S 30S LEFT. OKAY, FIRST UP, MR. BUTLER. HI. GOOD. GOOD EVENING. MY NAME IS STEVE BUTLER, AND I'M A DIRECTOR WITH THE WILBARGER CREEK CONSERVATION ALLIANCE. AND I'M TALKING ABOUT WASTEWATER DISCHARGE. AND I WANTED TO CONGRATULATE THE CITY FOR ADOPTING THE, THE, THE, THE MASTER PLAN FOR WASTEWATER. AND THE ONE THING THAT I REALLY WANT TO ASK YOU GUYS TO CONSIDER IS TO INCREASING THE WATER QUALITY
[00:10:03]
STANDARDS FOR THE MAYNOR RUN WASTEWATER TREATMENT PLANTS. AND SO LET ME BE CLEAR. OUR OUR ALLIANCE IS NOT AGAINST DEVELOPMENT. WE'RE NOT AGAINST NEW NEW WASTEWATER TREATMENT PLANTS. WE'RE WE'RE HERE TO TRY TO JUST MAKE IT A LITTLE BIT BETTER BECAUSE WE'RE AT A WE'VE GOT A GREAT GROWING CITY HERE. BUT THE PROBLEM IS THAT WE'VE GOT RIGHT NOW WE'VE GOT 11 EXISTING WASTEWATER TREATMENT PLANTS THAT ARE COMING DOWN INTO WALBURGER CREEK. NOW, TWO OF THE THREE PLANTS ARE MAINERS, AND THOSE ARE ONES THAT YOU GUYS CAN CONTROL. BUT WE'VE GOT A WE'VE GOT A TIDAL WAVE OF EFFLUENT COMING. THAT'S THAT'S NOT EVEN THAT'S BEEN PERMITTED ALREADY.AND NEW PLANTS THAT ARE ASKING TO BE PERMITTED RIGHT NOW. AND SO OUR, YOU KNOW, THE DRIPS THAT ARE COMING NOW ARE GOING TO BE A TIDAL WAVE SOON. AND SO THE TO WHAT I'M ASKING TO DO IS FOR THE CITY, FOR ITS TREATMENT PLANTS TO LOWER THE AMOUNT OF THE PHOSPHORUS ALLOWED TO BE DUMPED INTO THE CREEK FROM ONE ONE MILLILITER. PER, I'M SORRY, 1MG/L TO 0.0. 1ML/G. NOW, WHAT MAKES THIS? SO REASONABLE IS THAT WE'VE BEEN TOLD BY THE CITY OF AUSTIN STAFF, AND I'VE SPOKEN WITH CIVIL ENGINEERS AS WELL. AND THAT TO GET RID OF THAT ALGAE BLOOM THAT IS COMING UP EVERY YEAR IN THE CREEK. ALL WE NEED TO DO IS TO INCREASE THE AMOUNT OF ALUMINUM SULFATE THAT THE CITY IS USING CURRENTLY IN THE IN, IN THE WATER QUALITY THING. SO WHAT ALUMINUM SULFATE DOES IS ALUM IS THAT IT'S BASICALLY LIKE A SALT. AND IT AND IT ATTACHES ON TO THE PARTICULATES AND BRINGS THEM DOWN IN THE IN THE PROCESS. AND SO YOU ALREADY HAVE SOME SOLIDS THAT ARE 30S. I'M SORRY. 30S 30S. OKAY. WE ALREADY HAVE SOME THAT ARE COMING DOWN RIGHT NOW.
AND SO THIS BASICALLY ALLOWS THE TREATED EFFLUENT TO THE, THE BAD STUFF TO GET CAUGHT IN THE SLUDGE THAT'S DUMPED NOT IN THE CREEK. AND SO THIS IS VERY CHEAP AND EASY. THEY'RE ALREADY DOING IT WEST OF I-35 ALREADY. LIBERTY HILL HAS HAS GOT THEIR THEIR PARTICLES DOWN TO 0.02. THANK YOU. WHICH IS FAR WHICH IS FAR LESS THAN WHAT WE'RE ASKING. AND SO IT'S A CHEAP IT'S A CHEAP ADD TO THE CURRENT PROCESS THAT WOULD STOP THE ALGAE BLOOM AND WOULD MAKE EVERYTHING A LOT BETTER. THANK YOU. THANK YOU. LET'S SEE. ISABEL BEAL. AND YOU HAVE THREE MINUTES, SIR. YES, SIR. I'M GOING TO TALK ABOUT THE LOCATION OF YOUR REGIONAL WASTEWATER PLANT. MAYNOR ALREADY OWNS THE LAND. 20 YEARS AGO, WHEN MAYNOR ACQUIRED THE LAND, IT MIGHT HAVE MADE SENSE FOR A SEWAGE TREATMENT PLANT. NOW THAT ALL OF THE SURROUNDING LAND HAS BEEN. CONSERVED AND CANNOT BE DEVELOPED, IT'S NOT SUCH A GOOD PLACE. THE CONSERVATION EASEMENTS ON THAT SURROUNDING PROPERTY ARE PERPETUAL. THAT'S A MEANS FOR EVER, WHICH IS ESPECIALLY SHORT AS YOU GET CLOSE TO THE END. NOW IT'S A BETTER PLACE FOR A PARK OR WILDLIFE HABITAT. THESE EASEMENTS RUN WITH THE LAND. ALL FUTURE OWNERS MUST COMPLY WITH. THESE EASEMENTS PROHIBIT SUBDIVIDING THE PROPERTY. IT CANNOT BE DEVELOPED. OTHER LOCATIONS EXIST THAT ARE CLOSER TO DEVELOPMENT. WE HAVE A LOT OF VACANT LAND ADJACENT TO MY PLACE, TO THE NORTH AND TO THE EAST. THAT WOULD BETTER SUIT MAYNARD'S NEEDS. AND IT'S OUTSIDE OF CONSERVATION EASEMENTS. THE CHEAPEST LOCATION MAY NOT BE THE BEST, ESPECIALLY CONSIDERING THE FLOOD RISK
[00:15:06]
LOCATIONS EXIST OUTSIDE OF THE VIOLENT, DANGEROUS, AND FREQUENT FLOODING AND BUILDING CRITICAL INFRASTRUCTURE IN THE PROPOSED LOCATION DOESN'T MAKE GOOD FINANCIAL SENSE. THE CHEAPEST LOCATION MAY NOT BE THE BEST, CONSIDERING THE VALUE TO THE COMMUNITY OF PRESERVING THIS UNIQUE, BEAUTIFUL AND NATURAL 2000 ACRES LIKE DECKER LAKE, BARTON SPRINGS. ZILKER PARK AND EAST METROPOLITAN PARK, WILBARGER CREEK WILL BECOME MORE AND MORE VALUABLE TO FUTURE GENERATIONS. 30S, SIR. AS WATER BECOMES SCARCER AND DEARER, OUR FUTURE WILL INCLUDE THE REUSE OF TREATED WATER. THE CHEAPEST LOCATION MAY NOT BE THE BEST CONSIDERING THE COST OF SENDING REUSE WATER BACK UPHILL. SOME OF YOU MAY LIVE 50 MORE YEARS TO WITNESS THAT FUTURE. PLEASE WORK WITH TRAVIS COUNTY TO FIND A BETTER LOCATION. THANK YOU SIR. MISS ANNE.FIRST I WANT TO APOLOGIZE FOR GETTING UP HERE AGAIN. YOU WOULDN'T BELIEVE THAT I'M ACTUALLY AN INTROVERT, BUT WE'VE BEEN WORKING SO HARD FOR SO LONG TO SAVE THIS LAND THAT IT HAS FORCED ME TO COME OUT OF MY SHELL AND FIGHT FOR IT. SO, UNFORTUNATELY, WE HAVEN'T DONE A GOOD ENOUGH JOB OF KEEPING THE CITY OF MAYNARD INVOLVED. YOU KNOW, WE STARTED WORKING BACK WITH MAYOR JONES A LONG TIME AGO AND HAVEN'T DONE AS GOOD A JOB OF KEEPING FUTURE, YOU KNOW, STAFF MEMBERS AND EVERYBODY INFORMED OF WHAT WE'RE DOING OUT THERE. SO WE'RE TRYING TO PLAY CATCH UP NOW. SO EASTERN TRAVIS COUNTY WAS DESIGNATED A LONG TIME AGO AS THE DESIRED DEVELOPMENT ZONE. AND IT'S OFTENTIMES, YOU KNOW, SOMETIMES A DUMPING GROUNDS FOR OTHER STUFF. OTHER PEOPLE DON'T WANT. IT HAS BEEN HISTORICALLY UNDERSERVED. AND TRAVIS COUNTY IS TRYING HARD NOW TO BALANCE THE SCALES, TO DO SOMETHING NICE FOR US OVER HERE. DURING THE LAST FEW BOND ELECTIONS, THEY HAVE PUT MORE AND MORE MONEY TOWARDS PARKS AND OPEN SPACE ON THE EAST SIDE. IN THE LAST BOND ELECTION, THE CITIZENS VOTED FOR WELL OVER $200 MILLION FOR PARKS AND OPEN SPACE, AND TRAVIS COUNTY HAS DESIGNATED HALF OF THAT MONEY FOR THE EAST SIDE, AND A LARGE PORTION OF IT WILL BE SPENT ON THE WILBARGER CREEK GREENWAY. AND THIS LARGE PARK.
THAT'S $100 MILLION THAT THEY ARE GOING TO SPEND ON THIS BEAUTIFUL PARK FOR US OVER HERE, JUST EAST OF MAYNARD, WE HAVE AN OPPORTUNITY TO HAVE A WORLD CLASS PARK HERE THAT WILL BE CULTURALLY AND ECONOMICALLY BENEFICIAL FOR THE CITIZENS OF MANER. DEVELOPERS WILL LOVE THIS PARK BECAUSE PEOPLE WANT TO LIVE NEAR A PARK. BUSINESS OWNERS ALONG 280 WILL LOVE THIS PARK, BECAUSE PEOPLE WILL BE COMING FROM ALL OVER TO GO TO THE PARK AND THEY'LL STOP TO EAT AND GET SUPPLIES ON THE WAY TO THE PARK AND ON THE WAY HOME FROM THE PARK. THIS PARK WILL PUT MAYNOR ON THE MAP IN A WHOLE NEW WAY. WE'LL BE KNOWN FOR OUR PARK. WHICH ONE PARK EMPLOYEE HAS ALREADY TOLD ME IS THE PRETTIEST VIEW IN THE COUNTY. HE'S SEEN REIMERS RANCH. HE'S SEEN ALL THE PARKS. HE THINKS WE HAVE THE PRETTIEST VIEW IN THE COUNTY. THEY ALREADY OWN THAT LAND. AND THAT WILL BE LIKE ONE OF THE MOST BEAUTIFUL PLACES FOR PEOPLE TO GO. MY NEIGHBOR WAS JUST WALKING ALONG WILBARGER CREEK THE OTHER DAY, ALONG A TRAIL THAT WILL BECOME PART OF THIS PARK SOMEDAY, AND HE TEXTED ME BECAUSE HE HAD JUST SEEN A BOBCAT AND HER LITTLE CUB, AND HE SAID, THIS PLACE IS SUCH A BLESSING. WE WANT TO GIVE EVERYBODY THE CHANCE TO EXPERIENCE THIS BLESSING ONE DAY. THAT'S WHY WE HOPE YOU WILL WORK TOGETHER WITH TRAVIS COUNTY, AND WE WANT TO HELP YOU IN WHATEVER WAY WE CAN TO FIND A BETTER PLACE FOR THIS WASTEWATER TREATMENT PLANT AND KEEP THIS PARK PRISTINE FOR EVERYBODY TO ENJOY SOMEDAY. THANK YOU SO MUCH. THANK YOU.
[00:20:01]
SO.MUCH MORE. ALL RIGHT, NEXT UP FOR PUBLIC COMMENT, WE HAVE MISS DEBBIE YOUNG AND YOU HAVE THREE MINUTES, MA'AM. GOOD EVENING. IT'S GOOD TO BE HERE. I'M REPRESENTING HERE REPRESENTING TODAY THE MAYNARD ARTS COUNCIL AGAIN. I DON'T THINK I'VE BEEN HERE SINCE WE FINISHED THE ART, THE FENCE, THE ART FENCE. SO THE REHAB AND IT IT'S LOOKING GOOD. I HOPE YOU GUYS HAVE HAD A CHANCE TO GO BY THERE AND TAKE A LOOK. AND WE'RE REALLY PROUD OF HOW IT HOW IT TURNED OUT. I'M HERE TO ANNOUNCE OUR SECOND ANNUAL SIDEWALK CHALK ART EVENT THAT WILL BE AND ASK YOU TO SAVE THE DATE. FOR RIGHT NOW. WE ARE PLANNING OUR EVENT FOR SATURDAY, APRIL THE 26TH, FROM TEN TO 10 TO 2 AT THE SHADOW VIEW SHOPPING CENTER. WE'LL HAVE A RAIN DATE OF MAY THE 10TH IN CASE WE CASE WE GET RAINED OUT. THIS IS AN EVENT FOR IT'S FREE FOR EVERYONE. IT'S FOR ALL AGES. WE HAD A GOOD TURNOUT LAST YEAR AND WE HOPE TO HAVE EVEN MORE PARTICIPATION THIS YEAR, SO I'LL BE BACK NEXT MEETING WITH THE WITH OUR OFFICIAL FLIER, AND I HOPE THAT YOU'LL HAVE TIME TO STOP BY AND VISIT OUR EVENT AND CREATE SOME ART OR, YOU KNOW, ENJOY, ENJOY OUR COMMUNITY EVENT. SO THANKS. THANK YOU. LOOK FORWARD TO THE FLIER. AND. AND TYPICALLY WHEN WE DO PUBLIC COMMENTS, WELL, NOT TYPICALLY ALL THE TIME WE DO PUBLIC COMMENTS. THERE'S NOT A DIALOG BETWEEN US AND THE GUESTS THAT ARE DOING PUBLIC COMMENTS, BUT I DID WANT TO MAKE A STATEMENT THAT MIGHT BE HELPFUL FOR SOME CONTEXT IN THE DIRECTION THAT THE CITY IS MOVING. ONE. AND ONE OF THE THINGS IN PARTICULAR COUNCIL HAS DONE SINCE 2019 IS TO INVITE STATE AND COUNTY OFFICIALS TO BE A PART OF THE NEEDS AND THE GROWTH OF THE CITY OF MAYNOR, EVEN INTO THE PROCESS OF THE LAST BOND HOSTING BOND MEETINGS HERE WITH THE BOND COMMITTEE AND TRYING TO GET DIRECT INVESTMENTS IN THE NEEDS OF THE RESIDENTS AND THE CONCERNS AND ITEMS HERE AT THAT EFFORT WAS NOT ACCEPTED. AND WHEN WE ASKED TO HOW WHEN WE SUBMITTED PROJECTS FOR THE BETTERMENT OF THE CITY OF MAYNOR, THOSE PROJECTS WERE NOT MOVED FORWARD. AT OUR AT OUR REQUEST AND OUR ADVOCACY. AND SO TO FIND OUT THAT ONE, MY PROJECTS WERE TURNED DOWN, BUT TWO, THAT THE CONVERSATIONS ARE BEING HELD WITH EVERYONE ELSE BUT US IN REGARDS TO THE BETTERMENT OF THE CITY OF MAYNOR. IT'S KIND OF ALARMING BECAUSE WE WE'VE BEEN OPEN ARMS AND TRANSPARENT AND MAKING REQUESTS ABOUT WORKING TOGETHER FOR THE NEEDS OF THE CITY, AND SOUNDS LIKE OTHERS HAVE A LITTLE BIT MORE COMMUNICATION THAN WE ACTUALLY HAVE. AND THAT'S THAT'S DISAPPOINTING TO KNOW, ESPECIALLY WHEN $533 MILLION WAS ON THE LINE AND WE ASKED FOR REMEDIATION OF TRAFFIC, WHEREAS FOR HELP FOR PARK AND RECREATION FACILITIES OF THE OF THE IMMEDIATE NEED AND THOSE DOLLARS THAT ALSO COULD HAVE BEEN SET ASIDE TO HELP RELOCATE. BUT NONE OF THOSE THINGS WERE DONE BECAUSE THEY WERE NOT AT THE TABLE WITH US. AND SO I JUST WANT TO MAKE SURE THAT WHEN WE TALK ABOUT THE ENTITIES WANTING TO REMEDIATE THE LACK OF FINANCIAL INVOLVEMENT IN OUR CITY, THAT THOSE ENTITIES HAD, LIST OF PROJECTS THAT WERE BROUGHT TO THEM FOR AT LEAST THE LAST FIVE YEARS, BECAUSE SINCE I'VE BEEN ON THE COUNCIL AND THERE HAS BEEN NO MOVEMENT OR SUPPORT IN THOSE PROJECTS FOR THE BETTERMENT OF OUR COMMUNITY, FOR THE BETTERMENT OF WATER, WASTEWATER AND SO FORTH. AND SO I WANT TO MAKE SURE THAT THAT PART IS OUT THERE. SO BECAUSE THERE HASN'T BEEN WE'VE BEEN TRYING TO HAVE THOSE CONVERSATIONS AND MAKING SURE THAT THAT'S OUT THERE FOR THE PUBLIC. THAT BEING SAID, WE'LL
[CONSENT AGENDA]
MOVE ON TO THE CONSENT AGENDA. ALL THE ITEMS ON THE CONSENT AGENDA ARE CONSIDERED TO BE SELF-EXPLANATORY BY COUNCIL, AND WE WILL BE ENACTED WITH ONE MOTION. THERE WILL BE NO[00:25:02]
SEPARATE DISCUSSION ON THESE ITEMS UNLESS REQUESTED BY THE MAYOR OR COUNCIL MEMBER, IN WHICH THE ITEM WILL BE REMOVED FROM CONSENT AGENDA AND CONSIDERED SEPARATELY. NUMBER ONE CONSIDERATION. DISCUSSION. POSSIBLE ACTION ON ACCEPTING THE FEBRUARY 2025 CITY COUNCIL MONTHLY REPORTS NUMBER TWO CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON ACCEPTING THE FEBRUARY 2025 DEPARTMENTAL REPORTS. NUMBER THREE CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON A PROFESSIONAL SERVICE AGREEMENT FOR ARBITRAGE COMPLIANCE SERVICES FOR THE CITY OF MAYNARD AND NUMBER FOUR CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON THE PURCHASE AGREEMENT WITH JUANITA, NEVADA ON ON. ON FRIDAY, ANDRADE. THANK YOU FOR PUBLIC UTILITY EASEMENT COUNCIL MEMBERS, ARE THERE A MOTION ON THE FLOOR OR ANY ITEMS THAT YOU WOULD LIKE TO PULL? MR. MAYOR, I'D LIKE TO MAKE A MOTION THAT WE ACCEPT THE CONSENT AGENDA AS WRITTEN. WE HAVE A MOTION ON THE FLOOR BY COUNCILWOMAN DAMASCUS. IS THERE A SECOND? I SECOND, SECOND BY COUNCILWOMAN WALLACE. ANY QUESTIONS TO THE MOTION? BEING NONE. ALL IN FAVOR? OPPOSED. MOTION PASSES SEVEN ZERO. NEXT. MOVING ON TO THE REGULAR AGENDA. SECOND AND FINAL[REGULAR AGENDA]
READING. CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON AN ORDINANCE. REZONING FOR ONE LOT ON 4.879 ACRES, MORE OR LESS, AND BEING LOCATED AT 16023 EAST US 290 MAYNARD, TEXAS FROM GEO GENERAL OFFICE TO C2 MEDIUM COMMERCIAL. YES, SIR. COUNCIL, IF I MAY, MICHAEL BURRELL, INTERIM DEVELOPMENT SERVICES DIRECTOR FOR THE CITY OF MAYNARD. THIS IS A TYPO. IT SHOULD SAY C3 HEAVY COMMERCIAL. SO IT WILL NEED TO BE PULLED AND BROUGHT BACK ON THE SECOND. THE SUMMARY FORM WAS UPDATED EVERYWHERE WITH THE FIRST READINGS INFORMATION EXCEPT FOR THE SUMMARY FORM LANGUAGE AS WELL AS THE AGENDA TITLE. SO IT WILL BE BROUGHT BACK AT THE NEXT MEETING FOR YOU ALL TO FIND OUT. ALL RIGHT. NUMBER SIX, CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON THE RENTAL ASSISTANCE PROGRAM FOR A AND G INSURANCE AGENCY THAT OPENED BUSINESS IN MAYNARD LATE 2024. AND MR. JONES. MAYOR AND COUNCIL MEMBERS. WE HAVE A REQUEST FOR RENTAL ASSISTANCE PROGRAM. GRANT FOR THE RENTAL ASSISTANCE PROGRAM CREATED BY CITY COUNCIL TO PROVIDE ASSISTANCE IN THE FORM OF YOU HAVE IN YOUR PACKET BEFORE YOU A REQUEST IN THE. I THINK THE COPY OF THE APPLICATION AND PER THE GUIDELINES, THERE'S A UP TO $750 PER MONTH RENTAL ASSISTANCE AVAILABLE FOR THE FIRST SIX MONTHS, AND THEN A GRADUATED AMOUNT FOR THE SECOND SIX MONTHS. THE APPLICANT IS A AND G INSURANCE, AND THEY HAVE COMPLETED ALL OF THE REQUIREMENTS OF THE GUIDELINES. YOU HAVE A COPY OF THAT IN YOUR PACKET ALSO. AND THEY'VE COME TO THE CITY TO REQUEST HELP WITH THEIR RENT. IT'S A NEW BUSINESS THAT WAS ESTABLISHED IN NOVEMBER. THEY'RE LOCATED UP ON HIGHWAY 973 AND JUST BEEN IN BUSINESS FOR A FEW MONTHS. THEY ARE FAMILY OWNED, INSURANCE BROKERAGE AND LIKE I SAY, THEY HAVE THEY'VE COMPLIED WITH ALL OF THE REQUIREMENTS THAT COUNCIL HAS REQUESTED IN THEIR IN THE RENTAL ASSISTANCE PROGRAM, AND THE TOTAL OF THE GRANT WOULD BE $7,498. IF YOU APPROVE THE REQUEST, REIMBURSE MONTHLY AFTER PROOF OF PAYMENT TO THE LANDLORD IS RECEIVED BY THE CITY. SO ANY QUESTIONS THAT YOU ALL HAVE? I HAVE COPIES OF THEIR LEASE, I HAVE COPIES OF THEIR TAX RETURNS AND ALL THAT TO. AND I HAVE VERIFIED THAT THEY ARE AN EXISTING BUSINESS AND IN IN BUSINESS IN THE CITY OF MANER. DO YOU HAVE THEIR MARKETING PLAN? YES. YOU HAVE A COPY FOR US? YES I DO. IS THERE A BUSINESS OWNER HERE? YEAH, I. THEY EMAILED IT. IT'S EMAILED TO US. IT WAS, IT WAS EMAILED TO THEM WASN'T IT. YEAH. YEAH I HAVE A COPY OF IT HERE TOO. DO YOU. YEAH. IS THE BUSINESS OWNER HERE? I DON'T SEE HIM HERE TONIGHT. QUESTIONS? COMMENTS? COUNCIL MEMBERS. CAN WE POSTPONE THIS AND HAVE THEM SHOW UP JUST IN CASE? IF WE HAVE ANY[00:30:02]
QUESTIONS, I'D ASK HIM TO BE HERE. I DON'T KNOW WHY THEY'RE NOT, BUT YEAH, I WOULD REALLY APPRECIATE IF THEY WOULD SHOW UP. THAT'S ON. Y'ALL MAKE A MOTION. MAYOR. COUNCIL. I'D LIKE TO MAKE A MOTION THAT WE POSTPONE ITEM NUMBER SIX. UNTIL. UNTIL WHAT'S THE NEXT MEETING LIKE? APRIL 2ND REGULAR CITY COUNCIL MEETING. WE HAVE A MOTION ON THE FLOOR BY COUNCIL MEMBER MORENO. IS THERE A SECOND? SECOND? SECOND BY THAT COUNCILWOMAN? WE'RE QUESTIONS TO THE MOTION. ANY QUESTIONS TO THE MOTION BEING NONE. ALL IN FAVOR OPPOSED? MOTION PASSES SEVEN ZERO. I WILL COMMUNICATE THAT TO THE BUSINESS. THANK YOU. THANK YOU SIR. CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON A RESOLUTION. RESOLUTION APPROVING A CONTRACT FOR THE PURCHASE OF FINANCING OF PUBLIC WORKS VEHICLES MUST BE LOAN PENA. GOOD AFTERNOON, MAYOR AND COUNCIL. IN YOUR PACKET YOU'RE GOING TO FIND A RESOLUTION TO APPROVE THE CONTRACT FOR FINANCING FOR SEVEN UNITS FOR THE PUBLIC WORKS DEPARTMENT. THE CONTRACT IS FOR FROM GOVERNMENT CAPITAL CORPORATION. IT'S A FIVE YEAR CONTRACT AT THE RATE OF 5.37%. 35. 7%. AND THE ANNUAL PAYMENT WILL START UNTIL MARCH OF 2026. QUESTIONS? COUNCIL MEMBERS. MULLIN. WHAT WE ALREADY BUDGETED FOR THAT MANY CARS. THAT MANY VEHICLES? YES THAT'S CORRECT. ONLY TWO HAVE THE SPECS ON THERE. IS THERE A REASON OR SOME OF THE VEHICLES? THOSE TWO, WE HAVE TO ORDER THEM. OKAY. AND THE OTHER FIVE THERE, THEY WERE JUST DELIVERED TO PUBLIC WORKS. USUALLY IT TAKES LIKE A COUPLE OF YEARS TO ORDER A VEHICLE. WELL WE ORDER IT AND IT TAKES ABOUT A COUPLE YEARS TO GET THEM. AND THEY WERE ABLE TO FIND THOSE FIVE IN OUR DEALERSHIP. SO THAT'S WHY WE ARE TAKING ADVANTAGE INSTEAD OF WAITING, YOU KNOW, A COUPLE OF YEARS OR MORE QUESTIONS. THAT MEANS SEVEN MORE VEHICLES WILL GO OUT OF SERVICE, OR WILL THESE JUST BE ADDED TO WHAT'S ALREADY THERE IN THE WE ARE IN BECAUSE WE GOT MORE PERSONNEL? COUNCILWOMAN HILL NO, COUNCILWOMAN, WE ARE ANSWERING MY QUESTIONS. IF IT WAS TO REPLACE OR TO INCREASE THE NUMBER OF VEHICLES. OKAY.OTHER QUESTIONS. I'LL TAKE QUESTIONS OR A MOTION. MAYOR, COUNCIL, I'D LIKE TO MAKE A MOTION THAT WE APPROVE RESOLUTION NUMBER 2025 DASH TEN, APPROVING THE LEASE CONTRACT WITH GOVERNMENT CAPITAL CORPORATION FOR PUBLIC WORKS VEHICLES. AS TO FORM AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE CONTRACT. ONCE FINALIZED. WELL, A MOTION FOR BY COUNCILWOMAN WALLACE. IS THERE A SECOND? I SECOND. I'LL SECOND BY COUNCILWOMAN. ANY QUESTIONS TO THE MOTION? ANY QUESTIONS TO THE MOTION BEING NONE. ALL IN FAVOR? OPPOSED. MOTION PASSES SEVEN ZERO. THANK YOU. MA'AM. OH, YOU GOT ANOTHER COUPLE MORE CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON A RESOLUTION FOR THE PURCHASE OF PURCHASE AND FINANCING OF IT EQUIPMENT. YES, MA'AM. YES. THIS IS ANOTHER RESOLUTION FOR. PURCHASE FOR THE IT DEPARTMENT. THERE'S A LAPTOPS AND ALSO IS FINANCED THROUGH GOVERNMENT CAPITAL CORPORATION FOR FIVE YEARS AND THE SAME RATE 5.357. AND THE PAYMENTS WILL START ON MARCH OF 26. THESE ARE LAPTOPS THAT WILL BE USED. BY PD. SAME QUESTION I GUESS. IS THIS A REPLACEMENT OR ADDITIONAL STAFF? YOU'LL FIND IT INTERESTING TO KNOW THEY ARE REPLACEMENTS. OUR OLDEST LAPTOPS THAT ARE STILL IN USE ARE FROM
[00:35:05]
2011. IF YOU CAN IMAGINE THAT A LAPTOP ACTUALLY LASTS THAT LONG, BUT THE OLDEST ONES IN OUR POOL OF LAPTOPS ARE THAT OLD, BUT THEY REALLY ALL NEED TO BE UPDATED. AND SO THAT'S WHERE WE'RE AT NOW. OTHER QUESTIONS I WOULD SAY MAYOR COUNCIL TO WHEN WE LOOK AT IT NEEDS TO BE ARE WE GOING TO START BUDGET. THESE ARE SOME OF THE THINGS THAT WE LOOK AT WHEN WE ADD PEOPLE AND ADD EQUIPMENT. WE TRY TO MAKE SURE WE CAN BUDGET FOR IT. AND I THINK IN THE PAST, THE CITY HAS UTILIZED THIS OPTION TO BUY EQUIPMENT INSTEAD OF WAITING. AND WHEN YOU HAVE THE SHORTAGE OF CHIPS AND STUFF, THAT'S WHY SOME OF THE VEHICLES HAVE TAKEN SO LONG TO GET DELIVERED TO US.SO TO THAT TO THAT NOTE IS THAT IF WE CAN GET A PRICE LOCKED IN, IT CAN HELP BUDGET FOR IT, AND THAT ALLOWS US TO HAVE LESS DOWNTIME WITH IT TO TRY TO FIX SOMETHING LIKE THAT'S 14 YEARS OLD, 11 YEARS OLD. SORRY. YEAH. WELL, THAT'S WINDOWS 98. YEAH. OR 2000. 2000. YEAH. YEAH, THAT'S WHAT I'M SAYING. THAT'S ABOUT 98. WINDOWS. 98 OR OR 2000. YEAH. SO THE GOAL IS WE YOU KNOW, WE TRY TO PUT EMPHASIS TO STAFF TO TAKE CARE OF THE EQUIPMENT. AND YOU KNOW, AND SO BECAUSE WE KNOW THE TURNAROUND COULD BE FOREVER. SO WE THANK YOU FOR ALLOWING US TO BRING THIS OPTION TO YOU WITHOUT US HAVING TO DO SPARE PARTS. I THINK PHIL AND THE TEAM COULD DO THAT. BUT FOR THE WHERE WE ARE IN THE FIELD AND THE 24 HOURS THAT THEY NEED TO BE IN THEIR POSSESSION AND HANDS FOR THIS, EVEN THE VEHICLES, IT'S A IT'S A PLUS THAT WE HAVE AN OPTION TO GET THE EQUIPMENT SOONER THAN LATER. YEAH. WELL YOU CAN'T DO CYBERSECURITY OR YOU CAN'T DO CYBER CYBERSECURITY OR ANY, ANY OF THE NEW AI FUNCTIONS OR EITHER NEW SOFTWARE STUFF IF YOU'RE ON THE OLD SYSTEM. SO I KNOW THERE'S ALWAYS A LAG WITH CERTAIN GOVERNMENTAL SOFTWARE APPLICATIONS, BUT NOT THAT MUCH. OTHER QUESTIONS. JUST FOR CLARIFICATION, THE FIVE ANNUAL PAYMENTS IS THAT THE AMOUNT DIVIDED INTO FIVE ANNUAL PAYMENTS, NOT THAT ONE AMOUNT.
EVERY YEAR FOR FIVE YEARS. YES, IT'S FIVE PAYMENTS, YOU KNOW, THREE OR. OR THAT YOU CAN'T. IT LOOKS IT LOOKS LIKE THE PAYMENT WOULD BE 28,000. YEAH. STARTING IN 2026. SO THAT INCLUDES THE AMOUNT PLUS THE 5.357 INTEREST. OH OKAY. AND SO SINCE IT WAS IN THE 2425 BUDGET, DOES THAT MEAN IT WILL ALREADY COME OUT OF THAT BUDGET FOR THIS YEAR OR IT'LL COME OUT THE NEXT NEXT YEAR TO START FROM THERE? YES. OKAY. AND THAT'S WHERE IT'S ALREADY BEEN BUDGETED FOR IT TO MOVE FORWARD THERE. SO WE APPROVED IT IN 2425 FOR THIS YEAR TO HAPPEN. BUT IT'S NOT GOING TO START MAKING PAYMENTS UNTIL WE WANT TO MAKE OUR FIRST PAYMENT UNTIL AFTER. YES. BUT WE CAN ALLOCATE THOSE FUNDS FOR THIS YEAR COMING OUT FOR NEXT YEAR. IT'S JUST AN ENTRY IN THE ACCOUNTING SYSTEM TO ALLOCATE THE FUNDING. YEAH. SO IT'S GOING TO HAVE TO BE IN THE BUDGET FOR THAT FISCAL YEAR.
THAT'S EXACTLY WHAT I'M SAYING. YEAH I JUST WANT TO MAKE SURE IT'S SOMETHING THAT WE WILL WHEN WE SEE OUR. OUR 25 YEAR BUDGET. YES. EVERY YEAR WE WILL BUDGET. BUT THIS YEAR WE ALREADY BUDGETED FOR EQUIPMENT AND UNITS. BUT LIKE THEY TAKE YEARS TO COME OR TO FIND EQUIPMENT, WE HAVE TO ALLOCATE THE FUNDING AND THEN WE USE THOSE FUNDS FOR THE NEXT PAYMENT UNTIL IT'S PAID IN FULL FOR THE NEXT FIVE YEARS. OKAY. THANK YOU. I CAN'T WAIT FOR OUR BUDGET WORKSHOP GUYS NEXT WEEK. ANY OTHER QUESTIONS? COMMENTS? ALL RIGHT, ALL RIGHT. IS THERE A MOTION ON THE FLOOR? MAYOR COUNCIL, I'D LIKE TO MAKE A MOTION THAT WE APPROVE RESOLUTION NUMBER 2025 DASH 11, APPROVING THE LEASE CONTRACT WITH GOVERNMENT CAPITAL CORPORATION FOR IT EQUIPMENT AS TO FORM AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE CONTRACT. ONCE FINALIZED, WE'LL HAVE A MOTION ON THE FLOOR BY COUNCILWOMAN WALLACE. IS THERE A SECOND, SECOND, SECOND BY COUNCILWOMAN WEIR? ANY QUESTIONS TO THE MOTION? BEING NONE. ALL IN FAVOR? OPPOSED. MOTION PASSES SEVEN ZERO. MOVING ON TO NUMBER NINE. CONSIDERATION, DISCUSSION AND POSSIBLE ACTION FOR THE
[00:40:07]
PURCHASE AND FINANCING OF POLICE VEHICLES. THIS IS OUR THIRD CONTRACT FOR FINANCING ALSO WITH GOVERNMENT CAPITAL CORPORATION, FOR POLICE DEPARTMENT VEHICLES AND EQUIPMENT. THOSE WERE BUDGETED 23, 24 AND 2425 BUDGETS AND ALSO IS FOR A FIVE YEAR PLAN, THE SAME RATE 5.357%.STARTING ON MARCH THE 26TH. YOU GOT IT. SAME QUESTION. THESE ARE A MIX. IF YOU LOOK AT THE EQUIPMENT, HOW IT'S BROKEN DOWN. SO SOME OF THEM ARE REPLACEMENT AND SOME OF THEM ARE NEW WITH POLICE CARS. LIKE SHE WAS SAYING, WE ARE EXPERIENCING A LAG. SO THE FIVE PATROL CARS THAT WE ORDERED FOR THE 23, 22, 23 BUDGET YEAR HAVE STILL NOT BEEN DELIVERED YET, WHICH MEANS THE FINANCING FOR THOSE VEHICLES VEHICLES HAVEN'T COME TO Y'ALL YET. THEY WERE BUDGETED AND THE MONEY FOR THE PAYMENT IS IN THERE, BUT THAT'S HOW LONG WE'RE WAITING TO SEE EQUIPMENT DELIVERED WITH CARS CATCHING UP AND WHATNOT. WE'RE SEEING IT SLOW DOWN, BUT WHEN I ASKED FOR A TIME FRAME ON SOME OF THESE VEHICLES, THEY DID SAY THAT WE'RE LOOKING AT 12 MONTHS UNTIL WE SEE THESE VEHICLES HIT THE ROAD. SO WE COME TO Y'ALL TO ASK FOR THEM KNOWING THAT WE COULD BE A YEAR OR MORE UNTIL WE SEE THEM, AND THAT'S JUST WHERE WE'RE AT. BUT SOME OF THEM ARE REPLACEMENT AND SOME OF THEM ARE NEW, AND THERE'S ALSO SOME EQUIPMENT IN THERE THAT I CAN EXPLAIN. IF Y'ALL HAVE ANY QUESTIONS ABOUT HOW MANY ARE REPLACEMENT AND ARE THE AND ARE THE NEW ONES FOR NEW OFFICERS OR A NEW DIRECTION? WE DON'T HAVE ANY NEW OFFICERS. SO THE PATROL CAR IS A NEW ONE. ADMIN CAR REPLACEMENT AND THE CID CARS ARE REPLACEMENT. THE CID CARS ARE THE UNMARKED BLUE CARS YOU SEE RUNNING AROUND TOWN. THOSE ARE, I BELIEVE, 2015 OR 2016, AND THEY'RE ALL PRETTY MUCH ON THEIR LAST LEG. SO IT WAS IMPORTANT FOR US TO GET THOSE OUT OF THERE. THE TWO MOTORCYCLES THAT IS NEW TO OUR DEPARTMENT. THAT'S WHAT I WAS GONNA. VOLUNTEER.
YEAH. SO AS SOON AS WE WERE ABLE TO GET THAT EQUIPMENT, WE'LL FOCUS ON MAKING SURE THAT WE HAVE TWO EMPLOYEES THAT ARE TRAINED AND THEY WILL BE FULL TIME MOTOR OFFICERS. AND OBVIOUSLY WITH OUR TRAFFIC ISSUES, THEY WILL GET TO INCIDENTS A LITTLE QUICKER THAN HAVING TO PUSH A FORD OR A CHEVY THROUGH, YOU KNOW, CONSTANT TRAFFIC, THE TRANSPORT VAN, OUTFITTING, Y'ALL APPROVED THAT TRANSPORT VAN IN. I BELIEVE IT WAS 22, 23, ACTUALLY, IT MIGHT HAVE BEEN EARLIER THAN THAT BECAUSE IT WAS RIGHT IN THE MIDST OF COVID. AND WHEN WE PURCHASED THE VAN, IF YOU REMEMBER, THE CAR PRICES WENT UP SUBSTANTIALLY DURING THAT TIME, AND WE EXHAUSTED THE FUNDS THAT WE ALLOCATED FOR THAT VAN JUST TO PURCHASE THE VAN. AND SO WHAT THIS IS, IS WE'RE COMING BACK TO YOU FOR THE OUTFITTING OF THE THAT TRANSPORT VAN. WHAT THAT TRANSPORT VAN IS, IS IF THE OFFICERS ARE AT A BAR OR AT AN EVENT WHERE THERE'S MULTIPLE ARRESTEES, WHERE WE CAN'T HANDLE THE AMOUNT OF PEOPLE WHO HAVE TO BE TRANSPORTED TO THE JAIL IN A POLICE CAR, WE CAN UTILIZE THIS VAN TO TRANSPORT ONE ONE OFFICER GOING AS OPPOSING, AS OPPOSED TO SENDING EVERY OFFICER WE HAVE ON THE STREET DOWN TO THE JAIL. OKAY. QUESTIONS? WHAT IS THE BMW MOTORCYCLES STANDARD OR IS THERE OTHER DIFFERENT BRANDS. SO YES. SO THERE ARE TWO TYPES OF MOTORCYCLES GENERALLY USED BY LAW ENFORCEMENT ACROSS THE COUNTRY. AND IT'S A, YOU KNOW, A CULTURE WAR ON. YOU KNOW, THE OTHER ONE IS HARLEY-DAVIDSON.
BUT GENERALLY THE SPEED AND THE AGILITY THAT WE'RE LOOKING FOR OUR OFFICERS TO HAVE IS WITH THE BMW OPTION. APD, TRAVIS COUNTY, ALL THE AGENCIES AROUND US UTILIZE BMW.
[00:45:05]
THE QUESTIONS OR MOTION. THE MAYOR COUNCIL LIKE TO MAKE A MOTION THAT WE APPROVE RESOLUTION NUMBER 20 2512 APPROVING THE LEASE CONTRACT FOR THE GOVERNMENT CAPITAL CORPORATION FOR POLICE VEHICLES AS TO FORM AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE CONTRACT. ONCE FINALIZED, WE'LL HAVE A MOTION ON THE FLOOR BY COUNCILMAN MORENO. IS THERE A SECOND, SECOND, SECOND BY COUNCILWOMAN WEIR? ANY QUESTIONS TO THE MOTION? ANY QUESTIONS TO THE MOTION BEING NONE. ALL IN FAVOR, OPPOSED. MOTION PASSES SEVEN ZERO. THANK YOU. WELL, THERE WE GO. ALL RIGHT. NEXT UP. CONSIDER NUMBER TEN CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON A PROPERTY USE AGREEMENT BETWEEN CC LEISURE LLC AND THE CITY OF MANOR. MR. MOORE. MAYOR COUNCIL, THIS ITEM IS BEFORE YOU TO GET FINALIZED. BEFORE WE HAVE THE BIG BOUNCE OF AMERICA EVENT THAT'S SCHEDULED. IT WASN'T ON OUR LIST OF COMMUNITY EVENTS. THIS GROUP NOTICED VIDEOS THAT WE POSTED FROM LAST YEAR OUT AT THE EAST MANOR DEVELOPMENT PROPERTY.THEY'VE BEEN WANTING TO BRING A PRESENCE TO THE TO CENTRAL TEXAS, AND THEY SAW THE LAYOUT OF THE LAND AND THEY WERE REALLY EXCITED BACK IN DECEMBER, JANUARY TO HOST THE EVENT HERE.
AND WE WANTED SINCE IT'S A LEASE, A RENTAL, WE NEED TO HAVE THIS IN PLACE TO COVER US FROM ANY LIABILITY ISSUES. SO WE JUST WANT TO MAKE SURE WE HAD AN AGREEMENT BEFORE YOU TO GET APPROVED AND THEY CAN FINALIZE. I THINK THEY GOING TO PAY US ABOUT 12,000 FOR THE RENTAL OF THAT. THE LAND AND SPACE, THEY HAVE THEIR OWN SECURITY PLAN AND THEY HAVE EVERYTHING THAT'S THEY'RE GOING TO HIRE, I THINK POLICE OFFICERS AS OFF DUTY TO JUST BE THERE FOR THE EVENT. AND THEY GOT TO GET APPROVED BY ESD 12 FOR THEIR UNIT. OTHER FIRE SAFETY. REQUIREMENT. SO I JUST WANT TO MAKE SURE ANYTHING WE DO AT THE PROPERTY WE COVER OURSELF IN THIS PARTICULAR AGREEMENT WOULD ALLOW US TO DO SO. AND THE COMPANY IS REALLY EXCITED ABOUT MARKETING THE EVENT, WHICH WE'VE PROBABLY SEEN SOME. BUT NOW I'M JUST GOING TO GO AHEAD AND DO A FULL FLEDGED MARKETING EVENT OF THE FOR THAT SPACE FOR THEIR EVENT COMING UP IN APRIL. LET'S SEE. THEY'RE USING OUR PROPERTY FROM THE MARCH 31ST THROUGH APRIL THE 8TH. QUESTION. IN THE TERMS AND AGREEMENTS, ARE THEY ARE THEY AGAINST OR ENSURING THAT THEY'RE STATING MINOR AND UTILIZING THE CITY LOGO, OR IS THIS JUST A RENTAL, NOT A PARTNERSHIP? IT'S A RENTAL. OKAY. THE ADVERTISEMENT I SAW DOESN'T REALLY SAY THAT IT'S MINOR. IT ACTUALLY TARGETS AUSTIN. THE COMMERCIALS THEY RUN, IT SAYS AUSTIN. AND SO MOST PEOPLE ARE LOOKING FOR THIS AUSTIN EVENT, AND THERE'S A LOT OF DISCUSSION ON SOCIAL MEDIA. SO I DON'T KNOW IF THAT'S COMMUNICATION TO GIVE BACK TO THEM, BECAUSE PEOPLE KIND OF GOT DEFEATED ON SOCIAL MEDIA, AND AT LEAST THE FEW THAT I SAW, AND THEY WERE LIKE IT TURNED THEM OFF, THAT THEY COULDN'T FIND A LOCATION, THAT IT DIDN'T SAY MINOR. AND SO IT DOES SAY AUSTIN AND PUSH THE BUTTON. AND I THINK WE COULD I MEAN, AT THIS CASE, I KNOW THEY'VE BEEN MARKETING, BUT I THINK WITH THE SOCIAL MEDIA AND THE LOCATION WILL HELP, YOU KNOW, BRING MORE INTEREST BECAUSE IT'S INSTEAD OF JUST SAYING IT'S AUSTIN BECAUSE THEY COULDN'T FIND A LOCATION IN CENTRAL TEXAS OTHER THAN AUSTIN. SO NOW IT'S LIKE WHEN YOU GROW UP, YOU DON'T SEE WHERE YOU'RE FROM. YOU SEE WHERE YOU ARE. THE NEAREST CITY, BIG CITY. BUT SINCE WE HAVE THE OPPORTUNITY, SINCE IT'S THEIR FIRST EVENT, THEY WANT TO IF IT GOES WELL, THEY WOULD LIKE TO PLAN IT ON A REGULAR BASIS AND ANNUALLY. BUT FOR THE CASE OF THE AUSTIN, WE CAN JUST ASK IF THEY CAN DEFINITELY LOCATE IT BECAUSE IT'S IN MAIN OR NOT. AUSTIN.
YEAH, WELL, AND THAT'S IT. JUST TO HELP PEOPLE FIND IT. IF YOU SAY AUSTIN, THEY'RE GOING TO GO TO ZIKA OR ANY OTHER LARGE SPACE THINKING THAT IT'S GOING TO BE THERE IF THEY CHOOSE TO ASSUME THAT. BUT IF THEY CAN'T SEE THE LOCATION BECAUSE IT'S NOT AN ADDRESS THAT SAYS IT, UNLESS YOU DIG DEEP AND THEN SOMEWHERE ALL THE WAY DOWN THE THREAD, IT DOES SAY IN MINOR, BUT IT'S LISTED ALMOST HOW IT READS. IT'S ALMOST AS A SECONDARY SITE, LIKE THERE'S THIS BIG EVENT, BUT THEN IN MINOR, IT'S GOING TO BE ON THESE DAYS. AND SO JUST SOMETHING TO PASS ON TO THEM IF THEY WANT TO DEFINITELY MAKE SURE PEOPLE COME OUT, IF HE THEY MIGHT WANT TO PUT THE ACTUAL
[00:50:02]
LOCATION IN THERE SOME KIND OF WAY. THAT'S ALL. YES, MA'AM. COME ON UP. OKAY. SO ARE YOU SPEAKING ABOUT ON THE WEBSITE WHERE WHEN YOU LOOK AT BBA AND IT GOES STRAIGHT TO AUSTIN, TEXAS, MAIN OR TEXAS AND THE MAIN OR FAIRGROUNDS? NO, I'M, I'M THE, THE ACTUAL AD THAT THEY'VE PAID FOR. RIGHT. AND THAT'S THE ONE I WAS SPEAKING OF. AND SO YES, I'VE BEEN IN A DISCUSSION WITH ANYA ON KIND OF REVAMPING THAT SO THAT THEY KNOW IT'S MINOR. OKAY. AND WE DON'T HAVE FAIRGROUNDS. ALSO, ON THE BBA THING, IT DOES. YOU HAVE TO CLICK AUSTIN IN ORDER TO FIND IT. THERE'S NO SITE THERE FOR MINOR. IT DOES SAY AUSTIN. YES. YEAH. THANK YOU. THAT'S WHAT I WANT TO KNOW. THEY HAD DID ALL THIS ADVERTISING MAN. DO THEY MEET WITH EMERGENCY MANAGEMENT WITH US ON THIS. WE DID AN INITIAL REVIEW. WE REQUESTED THEM DURING THE PERMITTING PROCESS TO PROVIDE US THEIR EMERGENCY OPERATIONS PLAN. IT DID NOT MEET OUR STANDARD. AND SO I ASSIGNED A LIEUTENANT WHO IS SPECIALLY TRAINED IN EMERGENCY OPERATION PLANS TO WORK WITH THEM TO ENSURE THAT THEY UNDERSTOOD THE IMPORTANCE OF PROPER SECURITY AND PREPAREDNESS. AND THEY AGREED TO THE CHANGES THAT HE RECOMMENDED. YEAH, SO I THINK I THINK THE THERE'S TWO TYPES OF EVENTS. THERE'S ONE THAT DOES WHERE SOMEONE DOES SOMETHING IN PARTNERSHIP WITH THE CITY. THEN THERE'S ONE WHERE PEOPLE JUST RENT OR RENT THE PARK AND DO SOMETHING. AND THIS IS JUST SOMEONE RENTING AT THE PARK, AND THEY WANT TO DO SOMETHING, WHICH WOULD BE THE MAIN REASON WHY WE WOULDN'T HAVE KNOWN UPFRONT ABOUT THE OPPORTUNITY. BUT I THINK IF PEOPLE ARE GOING TO ADVERTISE SOMETHING BIG LIKE THAT, THEN WE WOULD WANT TO KNOW JUST BECAUSE WE GET THE QUESTIONS FROM HALF THE CITY THAT HAS MESSAGED ALL OF US ASKING US, YOU KNOW, HEY, WHAT'S GOING ON? WHERE IS THIS AT? AND THOSE KINDS OF THINGS, WE'RE LIKE, WHAT? WHAT EVENT? SO YEAH, JUST IF IT'S EVER SOMETHING BIG LIKE THAT, JUST SO WE CAN BE HAD A NOTIFICATION, YOU'RE COMING UP TO, COME ON UP. IT'S AN EFFORT. THE JOINT EFFORT. MAYOR, CITY COUNCIL MEMBERS VERONICA RIVERA, ASSISTANT CITY ATTORNEY. IF YOU SO CHOOSE TO MAKE A MOTION TO APPROVE THIS AGREEMENT, PLEASE INCLUDE THAT THE TERM OF THE AGREEMENT UNDER SECTION FOUR. IF YOU NOTICE THERE WERE BLANKS ON THERE, IT WOULD BE FROM MARCH 1925, WHICH IS TODAY'S DATE. AND THEY WERE REQUESTING AN EXTRA DAY AFTER THE EVENT. SO NOT APRIL 7TH, BUT AN EXTRA DAY AFTER THAT. SO TWO DAYS TO MAKE SURE THAT THEY GET ALL OF THEIR EQUIPMENT BACK OUT. SO APRIL 8TH, 2025 WOULD BE THE END OF THE TERM OF THIS AGREEMENT. SO. AND JUST A QUESTION ON THE LIABILITY AND THE MILLION DOLLAR RISK INSURANCE. IS THAT ENOUGH FOR SOMETHING THAT'S BIG? YES, SIR. THAT IS THE USUAL TERM. BUT AGAIN, IT IS WITHIN THE PURVIEW OF THE CITY COUNCIL TO REQUEST MORE. BUT THAT IS THE TERM THAT CITY LEGAL HAD PROVIDED. I GUESS. WHAT'S WHAT, WHAT TAKES PLACE IF, IF, GOD FORBID, ANYTHING BAD HAPPENS AND IT EXCEEDS A MILLION. IF IT EXCEEDS A MILLION, THERE WOULD THE CITY HAS A WAIVER AND IT WOULD, I BELIEVE IN THE DOCUMENT. IT WOULD SAY THAT THEY ARE STILL RESPONSIBLE. THERE'S THE LIABILITY. THEY'RE STILL LIABLE.OKAY. OTHER QUESTIONS? COMMENTS. I'LL TAKE A MOTION. OR QUESTIONS.
TAKE A MOTION OR QUESTIONS. GO AHEAD. ASK YOUR QUESTION. BECAUSE IT SAID 400 PARKING
[00:55:10]
SPACES. IS IT GOING TO HAVE ARE WE RESPONSIBLE FOR THE TRAFFIC ON 290 BEING WHAT IT COULD BE IN THAT AREA, LIKE OUR POLICE DEPARTMENT OR SOMEONE ELSE? I WOULDN'T SAY THAT WE'RE RESPONSIBLE. HOWEVER, IF THERE'S A SITUATION FOR THE SAFETY OF EVERYBODY, WE WOULD PROBABLY USE ON DUTY PERSONNEL TO GO AND TRY TO QUICKLY ADDRESS THE SITUATION AND GET TRAFFIC MOVING IF IT NEEDED TO BE IN THE OFFICER'S ON SITE THAT WERE HIRED BY THEM COULD POSSIBLY GO AND HELP. BUT THEIR MAIN PURPOSE OF BEING THERE IS THE SAFETY AND SECURITY OF THE PEOPLE AT THE VENUE AT THE TIME. SO I WOULDN'T SAY THAT IT'S OUR RESPONSIBILITY, BUT IF THERE IS AN ISSUE, YOU KNOW, LIKE ANYTHING ELSE CAUSED TRAFFIC ISSUE, WE WOULD DISPATCH ON DUTY OFFICERS TO GO AND SEE IF WE COULD ADDRESS IT. SINCE THE PARKING IS ON THE OTHER SIDE, HOW IS THAT GOING TO AFFECT OUR EASTER HELICOPTER DROP? LIKE THE GRASS THERE? ARE THEY LIKE, ARE THEY GOING TO MESS IT UP OR ANYTHING? YEAH, I THINK THE LOCATION THAT THE EASTER DROP WOULD BE FURTHER, FURTHER, FURTHER TO THE SOUTH. AND I THINK IF THERE'S ANYTHING FOR US TO RUTS OR ANYTHING, WE'LL, WE'LL MAKE SURE THAT'S LEVELED OFF. IF IT'S A, IF IT'S A DRY DAY, BUT MORE LIKELY IF THERE'S SOMETHING WHERE THE EASTER DROP WOULD BE EASTER EGG DROP, THAT AREA WOULD BE, YOU KNOW, KIND OF BLOCKED OFF IN THAT AREA, BE COMBED OVER JUST TO MAKE SURE WE DON'T HAVE ANY, ANY TRIP HAZARDS OR ANYTHING FOR THAT EVENT. AND THAT THAT WOULD BE THAT'S SCHEDULED FOR APRIL 19TH. OKAY. I GUESS I'M SORRY. I'M STILL GOING BACK TO THE TRAFFIC PART. WAS THAT A PART OF THEIR MEETING THE STANDARDS OR NOT MEETING YOUR STANDARDS? BECAUSE I GUESS THE WAY IT LOOKS AND YOU GUYS DID IT BEFORE WHERE YOU AT LEAST BLOCKED THAT CROSSING INTERSECTION. AND WHEN WE HAD SOME OF THE OTHER EVENTS, THERE'S THE LINE TO TURN IN WAS VERY LONG, AND IT WAS A LOT.YES. AND THIS, THIS WILL BE GOING ON DURING OUR REGULAR COMMUTE. THAT'S A LOT. YEAH. SO WHAT ARE THEY? SO I THINK THAT THE EVENT THAT YOU REMEMBERED THE REALLY BAD TRAFFIC WAS AT 4TH OF JULY AND THAT EVENT WAS HAD A SET OVERTIME. AND WHEN THE FIREWORKS WERE OVER, PEOPLE RUSHED TO JUST LEAVE WHERE THIS IS ONGOING. AND I DON'T THINK THAT WE WILL HAVE THAT MASS EXODUS AT ONE TIME. SO I THINK THAT THAT IS A POSITIVE AND THAT'S NOT HAVING TO DEAL WITH TOO MUCH ISSUE. BUT THE SAFETY PLAN FOR THE EVENT DID NOT. AND I CAN DOUBLE CHECK WITH LIEUTENANT RIDEAU, BUT I DON'T THINK THAT THAT WAS JUST A DISCUSSION OF THE SAFETY AND SECURITY OF THE RUNNING OF THE EVENT ITSELF. LIKE I SAID, IF SOMETHING HAPPENED, THE ON DUTY OFFICERS, YOU KNOW, COULD GO OUT THERE AND HANDLE THE SITUATION. I THINK SO. WILL IT AT LEAST HAVE THE LITTLE MARQUIS LIKE HOW YOU HAVE NOW ON THE ROAD AND IT SAYS LIKE THERE'S A CLOSURE OR SOMETHING ON THE 19TH THAT WAS SUPPOSED TO HAPPEN. WILL THEY BE LIKE, OH, HERE'S AN EVENT, TRAFFIC OR SLOW DOWN, JUST KIND OF WARNING SIGNS FROM WE CAN DEFINITELY UTILIZE THOSE. THOSE ARE CITY EQUIPMENT. SO WE GENERALLY WOULDN'T USE THOSE FOR A PRIVATE EVENT, BUT WE DEFINITELY COULD IF THAT'S SOMETHING THAT Y'ALL RECOMMEND. OH NO, I MEAN, THEY CAN FIND THEIR OWN, NOT OURS. YEAH, BUT THEY DEFINITELY THERE ARE RENTAL COMPANIES WHERE THEY COULD. AND I THINK THAT IF Y'ALL GAVE THAT DIRECTION THAT WE COULD ASK ASK THEM TO DO THAT. OKAY. THANK YOU. OKAY. I JUST LIKE HOW THEY DID THE RENAISSANCE THING UP TO 90, WHERE THEY ACTUALLY TOOK MORE EFFORT INTO BLOCKING OFF THE WAY AND MAKING EVERYONE GO AROUND. IT SEEMS A LOT SAFER BECAUSE I REMEMBER A LOT OF CRASHES CROSSING OVER. OKAY. THANK YOU. AND SO FROM THIS DIAGRAM THAT I'M LOOKING AT IS THERE'S ONLY ONE WAY IN, ONE WAY OUT. ACTUALLY, THERE IS A ANOTHER ENTRANCE EXIT THAT THE CITY PUT IN. I BELIEVE IT WAS JUST BEFORE THE 4TH OF JULY LAST YEAR. AND SO I BELIEVE THAT THAT WILL BE UTILIZED FOR EMERGENCY EGRESS. I THINK THE FIRE RAISED A CONCERN ON THAT AND THE ABILITY TO GET AN AMBULANCE IN. SO I BELIEVE THAT THAT IS IN THE PLANS TO UTILIZE BOTH ENTRANCES AND EXITS. OKAY. COOL. YEAH. I WAS JUST WONDERING IF WE'RE GOING TO UTILIZE THAT ENTRANCE. THANK YOU. I DO BELIEVE WE ALSO NEED TO BE AWARE THAT THE TIME
[01:00:07]
FRAME OF THE EVENT IS ALL DAY, BUT THEY HAVE DIFFERENT SECTIONS MARKED OFF, SO PEOPLE WILL BE COMING AND GOING KIND OF IN. WAS IT THREE HOUR SPURTS? I THINK IT'S A THREE HOUR. YOU HAVE A THREE HOUR TIME SLOT. SO PEOPLE WOULD BE GOING, COMING AND GOING EVERY THREE HOURS AND NOT EVERYBODY TRYING TO DEPART AT THE SAME TIME. SO. I HAVE A FEW QUESTIONS. YES, MA'AM. DO WE KNOW IF THEY'RE GOING TO BE CHARGING FOR PARKING SINCE THEY'RE RENTING THE SPACE? I DID NOT SEE THAT IN THE APPLICATION OR I DON'T THINK THAT THAT WAS PART OF IT. I THINK THE PARKING IS INTENDED TO BE FREE, BUT TRACY OR ANYBODY ELSE, MR. MOORE, I DON'T REMEMBER SEEING THAT. THAT THEY WERE CHARGING FOR PARKING. YEAH. GOOD. AND ALSO, WHO WOULD BE DOING THE ADVERTISING FROM ON THE CITY SIDE, IF ANY? IT'S NOT A CITY EVENT. SO WE COULD YOU KNOW, WE KNOW IT'S COMING. IT'S A RENTAL. IT'S LIKE IF SOMEBODY RENTED THE PARK, WE WOULDN'T NECESSARILY ADVERTISE UNLESS THEY CAME TO US LIKE THE FIVE K SINCE THEY DIDN'T COME TO US. SO. BUT IF THERE'S SOMETHING WE CAN POST ON OUR SOCIAL MEDIA TO KIND OF SAY, HEY, THIS IS COMING BECAUSE IT'S MORE OF A COMMUNITY EVENT, BUT WE WOULD MAKE SURE IT'S SOMETHING WE CAN POST ON SOCIAL MEDIA, NOT USE OUR MARKETING SPACE FOR AN EVENT THAT'S NOT A CITY COUNCIL APPROVED IT, GOT IT. AND THE ONLY WAY WE WOULD PUSH SOMETHING OUT IS IF THERE WAS AN IMPACT TO TRAFFIC OR SOMETHING. WE WOULD PUSH SOMETHING OUT. JUST SAYING. COMMUTERS, BE AWARE THAT, YOU KNOW, THIS SITUATION IS HAPPENING HERE. IT MAY CAUSE EXTRA TRAFFIC OR LAW ENFORCEMENT IS ON SCENE OR WHATEVER THE SITUATION IS, BUT IT WOULDN'T NECESSARILY BE A ADVERTISING.VERY GOOD. THANK YOU. AND TRACY, ARE THEY FINDING THEIR OWN FOOD CARTS TOO? I SAW WHERE THEY'RE KIND OF WANTING SIX OF THEM FOOD VENDORS OUT THERE. ARE THEY HANDLING ALL THAT? MAYOR. CITY COUNCIL TRACY VASQUEZ, HR DIRECTOR WITH THE CITY? ACTUALLY, YES. THEY'RE RESPONSIBLE FOR ALL OF IT. THEY'RE DOING FOOD TRUCKS, DRINK, DRINK TRUCKS. I DON'T BELIEVE THEY HAVE VERY MANY VENDOR LIKE MARKET VENDORS. AND SO UNLIKE CHIEF HAD SAID THERE, I DIDN'T SEE ANYTHING ON THE APPLICATION REGARDING PARKING AND CHARGING FOR PARKING. SO YES, THE CITY IS JUST RENTING. ALL RIGHT. IS THERE A MOTION ON THE FLOOR? MAYOR, COUNCIL, I'D LIKE TO MAKE A MOTION THAT WE APPROVE THE PROPERTY USE AGREEMENT BETWEEN CC LEISURE LLC AND THE CITY OF MAYNARD FOR THE RENTAL OF EAST DEVELOPMENT NUMBER ONE, MAYNARD EAST DEVELOPMENT NUMBER ONE, FROM. WE HAVE TO PUT TODAY'S DATE. YES, THE 19TH OF MARCH, 2025 TO THE 8TH OF APRIL, 2025. WELL, MOTION ON THE FLOOR BY COUNCILWOMAN WALLACE. IS THERE A SECOND? I SECOND, SECOND BY COUNCILWOMAN. ANY QUESTIONS TO THE MOTION? WELL, CAN WE MAKE SURE THAT IF THEY DO WANT TO MAKE THIS ONGOING, THAT NEXT TIME THEY COME AND PRESENT AND BE ASKING US INSTEAD OF, LIKE I SAID, THIS TIME THIS WAS KIND OF PUT ON US. BUT I THINK THE QUESTION IS, DO YOU WANT TO HEAR ALL PRIVATE RENTALS? YEAH, BECAUSE THEN THAT'S GOING TO BE THAT'LL BE A LOT. SO THAT'S I THINK THAT'S SOMETHING FOR YOU ALL TO CONSIDER. YEAH. BECAUSE THAT'S I THINK THAT'S THE DIFFERENCE IS WE THERE WAS A I THINK WE ALL UNDERSTAND AND PROBABLY OR SUGGEST THAT THIS WAS A CITY PARTNERSHIP, BUT IT ACTUALLY IS NOT. IT'S A, IT'S A PRIVATE RENTAL. SO EVERYTHING IS ON THEM. AS IF I WENT TO RENT A PARK FOR A PRIVATE BARBECUE. SO YOU'RE NOT GOING TO WANT TO ME TO COME UP. SO I THINK THAT'S THE KIND OF THE CONTEXT. ALL RIGHT. MOTION IS ON THE FLOOR. SECOND, ANY OTHER QUESTIONS TO THE MOTION? SEEING NONE. ALL IN FAVOR. OPPOSED. MOTION PASSES SEVEN ZERO. ALL RIGHT. JUMPING DOWN TO ITEM NUMBER 11.
CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON AN ORDINANCE AMENDING ARTICLE 1.05 OF THE CITY OF MAYNARD. CODE OF ORDINANCES TO CREATE ECONOMIC DEVELOPMENT COMMITTEE PROVIDING FOR MEMBERS OF THE COMMITTEE MEETINGS AND ITS PURPOSE. PROVIDING FOR SEVERABILITY
[01:05:03]
CLAUSE. PROVIDING STATEMENTS, EFFECTIVE DATE AND OPEN MEETINGS CLAUSES AND PROVIDING FOR RELATED MATTERS. MR. MOORE. MR. WELL, ACTUALLY, THESE ARE COUNCIL MEMBERS. THIS IS A RESULT OF OUR WORKSHOP, THIS ITEM NUMBER 11, 12 AND 13. SO IF YOU HAVE ANY SPECIFIC QUESTIONS ABOUT THE CREATION OF THESE COMMITTEES. THAT'S WHAT THAT'S WHAT THE NEXT ITEM IS GOING TO BE FOR. SO THE FIRST ONE UP IS ECONOMIC DEVELOPMENT. SO THIS WOULD CHANGE THE WAY THAT IT'S CURRENTLY. YOU KNOW THIS IS JUST ESTABLISHING REMEMBER THE THERE WERE SOME THAT WERE IN THE ORDINANCE IN OUR CHARTER AND THERE WERE SOME THAT WERE NOT. AND THEN THERE WERE SOME THAT NEEDED TO HAVE UPDATED ORDINANCES. AND SO THAT WE'RE JUST FIXING THE LANGUAGE AND, AND MATCHING WHAT'S IN THE CHARTER. YES, SIR. QUESTIONS ABOUT ECONOMIC DEVELOPMENT. IF THERE'S NO QUESTIONS, WE ENTERTAIN A MOTION. MAYOR, COUNCIL, I WOULD LIKE TO MAKE A MOTION THAT WE APPROVE ORDINANCE NUMBER 780, AMENDING ARTICLE 1.05 OF THE CITY OF MAYNARD CODE OF ORDINANCES TO CREATE THE ECONOMIC DEVELOPMENT COMMITTEE PROVIDING FOR MEMBERS OF THE COMMITTEE. THE COMMITTEE MEETINGS AND ITS PURPOSE, PROVIDING A SURVIVABILITY CLAUSE, PROVIDING A SAVINGS EFFECTIVE DATE AND OPEN MEETINGS CLAUSE, AND PROVIDING FOR RELATED MATTERS. A MOTION ON THE FLOOR BY COUNCILWOMAN WALLACE.IS THERE A SECOND? I SECOND. SECOND BY COUNCIL MEMBER MEAD, CAN YOU DEFINE OPEN MEETINGS CLAUSE SECTION SEVEN. CAN CAN I DEFINE THE OPEN MEETINGS CLAUSE? THIS IS THE YEAH. IN THE SENSE OF WHAT'S GOING TO CHANGE IN SOME MEETINGS THAT ARE HELD BY COUNCIL. THERE'S IT'S NOT A CLAUSE FOR IT OKAY. THE OPEN MEETINGS CLAUSE IS THE ONE THAT WE PUT ON ALL ORDINANCES THAT YOU TOOK ACTION AT AN OPEN MEETING. OKAY. NOW I JUST WANT TO MAKE SURE THAT IT'S UNDERSTOOD ON THE AIRWAVES. RIGHT? YES, MA'AM. SORRY. ALL RIGHT. WE HAVE A MOTION ON THE FLOOR. AND A SECOND. ANY OTHER QUESTIONS TO THE MOTION BEING NONE. ALL IN FAVOR? OPPOSED? MOTION PASSES. MOVING RIGHT ALONG TO ITEM NUMBER 12. CONSIDERATION. DISCUSSION.
POSSIBLE ACTION ON ORDINANCE AMENDING ARTICLE 1.05 OF THE CITY OF MAYNARD. CODE OF ORDINANCES TO CREATE A COMMITTEE. COMMUNITY COLLABORATIVE COMMITTEE PROVIDING FOR MEMBERS OF THE COMMITTEE MAINTENANCE AND ITS PURPOSE. PROVIDING FOR SEVERABILITY CLAUSE. PROVIDING THE SAVINGS, EFFECTIVE DATE AND OPEN MEETINGS CLAUSES AND PROVIDING FOR RELATED MATTERS. ANY QUESTIONS ABOUT THIS ONE? COUNCIL MEMBERS. IF NOT, I'LL ENTERTAIN A MOTION. MAYOR, I WOULD LIKE TO MAKE A MOTION THAT WE APPROVE ORDINANCE NUMBER 781, AMENDING ARTICLE 1.05 OF THE CITY OF MAYNARD CODE OF ORDINANCES TO CREATE THE COMMUNITY COLLABORATIVE COMMITTEE PROVIDING FOR MEMBERS OF THE COMMITTEE MEETINGS AND ITS PURPOSE. PROVIDING FOR SEVERABILITY CLAUSE, PROVIDING A SAVINGS EFFECTIVE DATE AND OPEN MEETINGS CLAUSES AND PROVIDED FOR RELATED MATTERS. WELL. MOTION FOR BY COUNCILMAN MORENO.
IS THERE A SECOND? I SECOND, SECOND BY COUNCILWOMAN. ANY QUESTIONS TO THE MOTION? I HAVE A QUESTION. YES, MA'AM. FOR THE MEMBERSHIP. THE PART B THAT IS COMPOSED OF SEVEN MEMBERS IS THIS ONE THAT WILL REMAIN SEVEN MEMBERS NO MATTER WHAT OR SINCE. IT INCLUDES THE HOMEOWNERS ASSOCIATIONS, DOES THAT MEAN OUR REPRESENTATIVE FROM THEM AS WE GROW? DOES THIS ORDINANCE CHANGE TO INCLUDE THAT AS WELL JUST AS IT CONTINUES? SAME WITH, I GUESS, SCHOOL DISTRICTS. YOU SAID SEVEN MEMBERS. IT SAYS THE COMMITTEE SHALL BE COMPOSED OF SEVEN MEMBERS AS FOLLOWS. THAT'S A MINIMUM, CORRECT? THAT IS A MINIMUM. AND IT WOULD BE CHANGED BY ORDINANCE IF IT GOES UP. AND AGAIN THESE. THE CHARTER DOESN'T READ MEMBERSHIP. IT JUST IT READS WHO IS SUPPOSED TO BE A
[01:10:02]
PART OF IT, BUT IT DOESN'T SAY HOW MANY. SO YES, COUNCIL MEMBER HILL, AT A LATER DATE, YOU COULD BRING BACK THIS ORDINANCE TO INCREASE THE MEMBERSHIP, OR YOU CAN DO IT RIGHT NOW. THIS IS AGAIN BASED ON THE INFORMATION IN THE CHARTER. WE PROVIDED THIS MEMBERSHIP AT A MINIMUM. YEAH.SO A IS MORE OF THE LANGUAGE THAT I'M FAMILIAR WITH. B. HAS LANGUAGE OF THE RECOMMENDED NUMBER. THE RECOMMENDED TYPES. BUT I THINK I THINK SHALL. CLARITY ON A SHALL IT STATES SHALL IS BECAUSE IN THE CITY CHARTER IT MENTIONED ALL OF THESE REPRESENTATIVES BUT NOT AS A MAXIMUM NUMBER OF PEOPLE. RIGHT. NOT THE MAXIMUM NUMBER OF PEOPLE. OKAY. SO WE WOULDN'T HAVE TO COME BACK TO, TO ADD ANYTHING BECAUSE A ALREADY GIVES THAT PROVISION IN THE LANGUAGE.
YOU WOULD. BECAUSE RIGHT NOW IT'S SAYING THAT IT SHALL BE COMPOSED OF SEVEN MEMBERS. IF YOU WANTED TO INCREASE THE MEMBERSHIP, YOU WOULD NEED TO COME BACK AND UPDATE THIS ORDINANCE TO THE NUMBER OF MEMBERS YOU WOULD LIKE THIS COMMITTEE TO HAVE. OKAY, THEN THAT'S NOT WHAT WE WANT AND BE YOU. OKAY, SO YOU WANT THE COMMITTEE MAY BE COMPOSED OF SEVEN MEMBERS OR MORE. YEAH. I THINK THAT THE TYPE WE'RE WANTING TO HAVE THE TYPE. SO A IS PERFECT BECAUSE THAT'S THE MINIMUM. THAT'S WHAT WE'RE SEEKING AFTER. BUT WE DO NOT WANT TO HAVE A I'M FINE WITH A MINIMUM NUMBER OF SEVEN. BUT BUT THAT BEING THE CAP IS DEFINITELY NOT WHAT WE'RE LOOKING FOR. OKAY. SO THEN IT'S JUST THE COMMITTEE SHALL BE COMPOSED OF AT A MINIMUM SEVEN MEMBERS. YES, MA'AM. IS THAT WHAT YOU WERE ASKING? OKAY. SO. AT A MINIMUM, SHE'S JUST GOING TO ADD IN A MINIMUM OF THE SEVEN MINIMUM. YEAH. SO WE NEED TO BRING THIS BACK. NO, MA'AM. WE CAN MAKE THAT CHANGE AS LONG AS. HAD THE MOTION HAD ALREADY BEEN MADE.
AND IF YOU CONSIDER THIS A FRIENDLY AMENDMENT, THOSE THAT MADE THE MOTION, THEN WE'LL ADD THAT TO IT. MAYOR, COUNCIL LIKE TO MAKE A FRIENDLY AMENDMENT AS DISCUSSED. THAT'S A FRIENDLY AMENDMENT BY. COUNCILMAN MORENO. COUNCILMAN. WOMAN. YES. I SECOND OKAY. AND SECOND BY AGAIN BY COUNCILWOMAN ESCALON. ANY OTHER GOOD CATCH, COUNCILWOMAN HERE. ANY OTHER COMMENTS OR QUESTIONS? OKAY. BEING NONE. ALL IN FAVOR. OPPOSED. MOTION PASSES SEVEN ZERO. ALL RIGHT. NOW THIS ONE COMING UP IS GOING TO HAVE SOME DISCUSSION I BELIEVE. YES. NUMBER 13 CONSIDERATION DISCUSSION. POSSIBLE ACTION ON A RESOLUTION AMENDING RESOLUTION NUMBER 2024 DASH 20 AND 20 2437 TO AMEND THE CITY STAFF LIAISON AND A CITY COUNCIL LIAISON ADMINISTRATION OFFICE TO ADMINISTER AND PROVIDE SUPPORT FOR THE MANOR YOUTH ADVISORY COUNCIL. SO THIRTEEN'S INFORMATION IS WHAT YOU ALL PROVIDED BACK TO US BASED OFF OF OUR WORKSHOP. THE QUESTIONS AND ANSWERS THAT FROM THAT DISCUSSION, CORRECT. WHAT WE WOULD LIKE TO DO IS JUST GET INFORMATION AND ADDITIONAL FEEDBACK FROM THE CITY COUNCIL BASED ON WHAT WE DRAFTED, WE JUST DIDN'T BELIEVE THAT WE HAD GOTTEN EVERYTHING THAT YOU ALL MAY HAVE WANTED, OR POSSIBLY NOT GOTTEN IT WRONG. CORRECT. SO THAT'S WHY WE'D RATHER PROVIDE YOU THE INFORMATION THAT WE DRAFTED AND OBTAIN SOME ADDITIONAL FEEDBACK, AND THEN WE CAN BRING IT BACK TO YOU. FOR APPROVAL ON APRIL THE APRIL THE 2ND. OKAY. AND ESPECIALLY BECAUSE THERE ARE SEVERAL DOCUMENTS, NOT JUST THE RESOLUTION, BUT THE BYLAWS AND THE PROGRAM. DEFINITELY LOOK AT SECTION TWO. COUNCIL MEMBERS. WHICH DOCUMENTS ARE THREE? I'M SORRY. THE RESOLUTION LANGUAGE.
[01:15:08]
OKAY. BECAUSE THAT'S THAT'S WHERE WE HAD A LOT OF CONVERSATION THAT. AND DEPENDING ON YOUR ANSWERS IN SECTION TWO, I'LL THINK ABOUT SECTION THREE AS WELL. AND THEN.IN THE APPOINTMENT OF THE STAFF. ARE WE STILL LEANING TOWARDS A SINGLE STAFF LIAISON OR DO YOU HAVE MR. MOORE, DO YOU HAVE A BACKUP PROTOCOL? IN THE IN THIS PARTICULAR CASE, WHERE SHOULD SOMEONE BE SICK? YOU KNOW, THAT KIND OF THING AND OR RESPONSIBILITIES HAVE TO SHIFT WITH THOSE, NOT JUST ONE KEEPER OF ALL THE INFORMATION. YEAH. I MEAN, WE'RE THINKING INTERNALLY UNDER THE ADMINISTRATION, WHICH WOULD FALL UNDER MYSELF OR UNDER THE CITY SECRETARY. WE'RE TRYING TO MAKE SURE WE HAVE NOT JUST ONE PERSON. SO THINGS ARE INVOLVEMENT WITH WHERE WE'VE AT THE LAST MEETING. WE FEEL THAT WE CAN HAVE MORE OF A, A BETTER HANDLE ON ANYTHING RELATED TO THE YOUTH. AND OUR INVOLVEMENT WILL ALLOW US TO BE ABLE TO, NOT JUST ONE PERSON. SO IF IT'S UNDER THE ADMINISTRATION AND WE GET DIRECTION FROM COUNCIL OR OTHER FEEDBACK, IT WOULD COME STRAIGHT FROM ME RATHER THAN A STAFF PERSON TRYING TO ORGANIZE MORE THAN BECAUSE IT'S NOT ABOUT THE PERSON, IT'S ABOUT MAKING SURE THE YOUTH ARE EMPOWERED TO DO THIS CHARGE FOR THE FOR THE YOUTH ADVISORY COMMISSION. AND WE'RE JUST THERE TO MAKE SURE THE STRUCTURE IS THERE FOR THE SUPPORT FROM THE ADMINISTRATION. SO TO THAT POINT, WE WOULD NOT JUST BE ONE PERSON ASSIGNING MORE, MORE THAN LIKELY TO FALL WITH MYSELF OR CITY SECRETARY'S OFFICE TO MAKE SURE WE HAVE THAT COVERAGE. OKAY. MAYOR, ARE WE ABLE TO GO INTO EXECUTIVE SESSION WITH THIS? IS A LEGAL QUESTION. MAYBE. ALL RIGHT. IF IT'S A LEGAL QUESTION, YES, MA'AM. THEN PLEASE. ONE SECOND.
ALL RIGHT. CITY COUNCIL WILL CONVENE TO EXECUTIVE SESSION PURSUANT TO THE PROVISIONS OF, YOU KNOW WHAT? WHY DON'T WE WHY DON'T WE HOLD THIS ONE? BECAUSE WE GOT WE HAVE TO GO TO EXECUTIVE SESSION ANYWAY. TAYLOR. TO AFTER EXECUTIVE SESSION ANYWAY. YEAH. AND THEN WHAT. WHAT DEAL WITH IT THERE. BECAUSE WE GOT TO GO ANYWAY. SO WE MIGHT AS WELL DO DO EVERYTHING WE GOT TO DO AND THEN COME BACK AND DEAL WITH THAT. AND ITEM NUMBER 14 THANK YOU. SO I NEED A MOTION FOR THAT TO TABLE AND DISCUSS DURING EXECUTIVE. MAYOR, I'D LIKE TO MAKE A MOTION THAT WE TABLE ITEM NUMBER 13 TILL AFTER EXECUTIVE SESSION. WE HAVE A MOTION ON THE FLOOR FINDING NUMBER 13. IS THERE A SECOND? I SECOND. SECOND BY COUNCILWOMAN WALLACE. MOTION ON THE FLOOR TO TABLE 13 AND DISCUSS WITH LEGAL DURING EXECUTIVE SESSION. IS THAT CORRECT? CORRECT. ALL RIGHT. ALL IN FAVOR? OPPOSED. MOTION PASSES. CITY COUNCIL WILL NOW
[EXECUTIVE SESSION]
CONVENE INTO EXECUTIVE SESSION PURSUANT TO THE PROVISIONS OF CHAPTER 5.1, TEXAS GOVERNMENT
